Terms of Use

1. Scope

These Terms of Use govern the use of the iOS app "Quitso" and the associated website. The operator is Maximilian Rechenauer, Am Stadtrand 43, 8600 Dübendorf, Switzerland (the "Operator"). By using the app, you agree to these Terms.

2. Description of the Service

Quitso lets you record group expenses and payments and automatically calculates balances within a group. No user account and no registration are required. The app is completely free of charge, contains no advertising and no in-app purchases.

3. No Payment Service

Quitso does not execute payments and is not a payment or financial service. The app merely calculates who owes whom which amount. The actual settlement of debts takes place outside the app and is solely the responsibility of the persons involved. Calculated balances are provided for information only; no warranty is given for their correctness in any individual case.

4. User Content

Content such as group names, person names, and the titles, amounts and dates of expenses is entered by users themselves. Users are solely responsible for this content. Content that is unlawful, offensive or infringes third-party rights must not be entered.

5. Proper Use and Prohibition of Misuse

The app may only be used for its intended purpose. In particular, the following are prohibited:

• any abusive, unlawful use or use that disrupts operation of the service;
• attempts to gain unauthorized access to data of other groups;
• systematically guessing invite codes.

Please note: anyone who knows an invite code or invite link can join the corresponding group and view its contents. Therefore, share codes and links only with people who are meant to be part of the group.

6. Availability

There is no entitlement to uninterrupted availability of the app or the underlying services. The app also works offline; however, synchronization between devices requires an internet connection. The Operator may modify, interrupt or discontinue operation of the app at any time.

7. Warranty and Liability

The app is provided free of charge and "as is". To the extent permitted by law, all warranties are excluded, in particular regarding freedom from errors, continuous availability and fitness for a particular purpose. To the extent permitted by law, the Operator's liability for slight negligence as well as for indirect and consequential damages is excluded. Mandatory statutory liability, in particular for unlawful intent and gross negligence, remains unaffected.

8. Apple End User License Agreement

For downloads of the app via the Apple App Store, Apple's standard end user license agreement (Licensed Application End User License Agreement, "Apple Standard EULA") additionally applies. Apple is not a party to these Terms of Use and has no maintenance or support obligations with respect to the app.

9. Changes to these Terms

The Operator may amend these Terms of Use at any time, for example in the event of changes to the app's functionality or changed legal requirements. The current version published on the website is authoritative. Continued use of the app after a change constitutes acceptance.

10. Governing Law and Jurisdiction

Swiss law applies, excluding its conflict-of-laws rules. The place of jurisdiction is the Operator's place of residence in Switzerland. Mandatory consumer-protection provisions, in particular mandatory places of jurisdiction at a consumer's place of residence, remain reserved.
